Terms of Service

1. About Dr. Fluffy

Dr. Fluffy is a digital pet care, wellness and record-keeping platform. The Service may allow users to create pet profiles, store pet care and medical information, upload photos and documents, receive AI-assisted summaries and recommendations, track routines, connect selected third-party services and share pet records with trusted people.

Dr. Fluffy is not a veterinary clinic, emergency veterinary service or substitute for professional veterinary advice.

2. Eligibility

You must be at least 16 years old to use the Service, unless a higher age is required in your country.

If you use the Service on behalf of another person, organisation or household, you confirm that you have the right to do so.

You are responsible for ensuring that your use of the Service complies with all laws and regulations applicable to you.

3. Account registration

Some features require an account.

You agree to provide accurate, complete and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must notify us immediately if you suspect unauthorised access to your account.

We may refuse registration, suspend access or close an account if we reasonably believe that the account is used in breach of these Terms, applicable law or the legitimate interests of Dr. Fluffy, other users, animals or third parties.

4. Pet records and user content

You may upload, enter, store, generate or share information through the Service, including pet profiles, medical records, symptoms, treatment notes, photos, documents, receipts, feeding records, activity data and other materials (“User Content”).

You remain responsible for your User Content.

By using the Service, you grant Dr. Fluffy a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, display, analyse, transmit and otherwise use your User Content only as necessary to provide, secure, maintain and improve the Service, including AI-assisted features, OCR, image analysis, technical support, backups and integrations.

You confirm that you have the necessary rights and permissions to upload and process any User Content you submit.

You must not upload content that:

• violates applicable law;
• infringes third-party rights;
• contains malware or harmful code;
• is fraudulent, misleading or abusive;
• contains unnecessary personal data about other people;
• is used to harm, harass, exploit or impersonate another person;
• interferes with the security or operation of the Service.

5. AI-assisted features

The Service may include AI-assisted features such as summaries, trend analysis, food or photo interpretation, OCR-assisted extraction, wellness suggestions, care reminders, risk indicators and conversational recommendations.

AI-generated content may be incomplete, inaccurate or inappropriate for your specific situation. You must use your own judgement and consult a qualified veterinarian where appropriate.

AI output is provided for informational and organisational purposes only. It is not veterinary diagnosis, medical treatment, emergency advice or a guarantee of your pet’s health condition.

You must not rely on AI output where immediate professional veterinary care may be required.

In case of emergency, contact a veterinarian or emergency veterinary service immediately.

6. No veterinary-client relationship

Use of Dr. Fluffy does not create a veterinarian-client-patient relationship between you and Dr. Fluffy.

If Dr. Fluffy provides access to third-party veterinarians, consultants or live support, such services may be subject to additional terms. Any veterinary advice provided by an independent professional is the responsibility of that professional, unless otherwise required by law.

7. Integrations and third-party services

The Service may allow you to connect third-party services, devices, platforms or applications, such as health, fitness, activity, payment, authentication, cloud storage or app store services.

Your use of third-party services is subject to their own terms and privacy policies. We do not control and are not responsible for third-party services.

You may disconnect integrations where the Service or the third-party platform allows this.

Some features may stop working if you disconnect or restrict an integration.

8. Subscriptions, paid features and billing

Some parts of the Service may be free. Other parts may require a paid subscription or one-time purchase.

Prices, billing periods, trial periods, renewal terms and cancellation options will be shown before purchase where required.

If you purchase through Apple App Store, Google Play or another third-party platform, billing, renewal, cancellation and refunds may be handled by that platform under its own terms.

Unless stated otherwise, subscriptions automatically renew until cancelled. You are responsible for cancelling your subscription before the renewal date if you do not want it to renew.

We may change prices or subscription features in the future. Where required by law, we will notify you in advance.

Nothing in these Terms limits your mandatory consumer rights, including any withdrawal, cancellation or refund rights that apply under the laws of your country.

9. Acceptable use

You agree not to misuse the Service.

You must not:

• use the Service for unlawful, fraudulent or harmful purposes;
• attempt to gain unauthorised access to systems, accounts, data or infrastructure;
• interfere with, disrupt, overload or damage the Service;
• reverse engineer, scrape, crawl or extract data from the Service except where legally permitted;
• bypass access controls, subscription limits or technical restrictions;
• use bots, scripts or automated tools without our permission;
• upload malware, harmful code or security exploits;
• impersonate another person or organisation;
• submit false, misleading or fabricated information;
• use the Service to abuse, threaten, harass or harm others;
• use the Service in a way that may harm animals;
• use AI features to generate unlawful, unsafe or abusive content;
• resell, sublicense or commercially exploit the Service without our written permission.

10. Suspension and termination of access

We may suspend, restrict or terminate your access to the Service, in whole or in part, if we reasonably believe that:

• you have breached these Terms;
• your account is used for illegitimate, unlawful, fraudulent, abusive or harmful actions;
• your use creates security, legal, technical or reputational risks;
• your use may harm Dr. Fluffy, other users, animals, third parties or the operation of the Service;
• we are required to do so by law, court order, regulator, app store or payment provider;
• your subscription has expired, been cancelled or payment has failed.

Where reasonable and legally permitted, we may notify you and give you an opportunity to correct the issue. However, we may act immediately where necessary to protect the Service, users, animals, third parties or legal compliance.

If your account is terminated, your right to use the Service ends immediately.

11. Availability and technical changes

We aim to provide a reliable Service, but we do not guarantee uninterrupted, error-free or permanent availability.

The Service may be unavailable, limited or interrupted due to:

• maintenance;
• updates;
• bugs or technical failures;
• cyberattacks or security incidents;
• hosting or infrastructure failures;
• third-party service outages;
• app store or platform restrictions;
• force majeure events;
• legal or regulatory reasons.

We may modify, suspend, discontinue or replace features from time to time. We may also impose reasonable technical limits on storage, uploads, API usage, AI requests, integrations or other features.

12. Data loss and backups

We take reasonable measures to protect and preserve data processed through the Service. However, no digital service can guarantee that data will never be lost, corrupted, delayed or unavailable.

To the maximum extent permitted by law, Dr. Fluffy is not responsible for loss, corruption or unavailability of data caused by technical failures, user error, third-party service failures, device issues, network problems, cyber incidents, maintenance, force majeure events or other circumstances outside our reasonable control.

You are responsible for keeping your own backup copies of important records, documents, photos and information, especially where such information is medically, legally, financially or emotionally important.

Where technically possible, we may provide export or download features, but we do not guarantee that all data will always be recoverable after deletion, account closure, subscription expiry or technical failure.

Nothing in this section excludes liability that cannot legally be excluded.

13. User responsibility for pet care

You are responsible for the care, health and safety of your pet.

The Service may help you organise information, notice patterns or prepare for a veterinary consultation, but it cannot replace your judgement or the judgement of a qualified veterinarian.

You should consult a veterinarian before making important decisions about diagnosis, treatment, medication, diet, supplements, emergency care or changes to an existing care plan.

You must not delay seeking professional veterinary help because of information shown by the Service.

14. Intellectual property

The Service, including software, design, branding, text, graphics, icons, logos, databases, AI workflows and other materials, is owned by Dr. Fluffy or its licensors and is protected by intellectual property laws.

You may use the Service only as permitted by these Terms.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer or create derivative works based on the Service unless we expressly allow it or the law gives you the right to do so.

The name “Dr. Fluffy”, related logos, mascots, designs and branding are trademarks or trade identifiers of Dr. Fluffy or its licensors.

15. Feedback

If you send us feedback, ideas, suggestions or improvement requests, you allow us to use them without restriction or compensation to you, unless we agree otherwise in writing.

You should not send us confidential information as feedback unless we have separately agreed to receive it confidentially.

16. Privacy

Our processing of personal data is described in our Privacy Policy.

By using the Service, you acknowledge that we process personal data as described in the Privacy Policy.

The Privacy Policy forms part of the overall relationship between you and Dr. Fluffy but does not reduce your rights under applicable data protection laws.

17. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we do not guarantee that:

• the Service will always be available, secure or error-free;
• all bugs or defects will be corrected;
• AI-generated content will be accurate, complete or suitable for your situation;
• OCR, image recognition or data extraction will always be correct;
• integrations will remain available or compatible;
• stored data will never be lost or corrupted;
• the Service will meet all your expectations or requirements.

Nothing in these Terms affects warranties or rights that cannot be excluded under applicable consumer law.

18. Limitation of liability

To the maximum extent permitted by law, Dr. Fluffy will not be liable for:

• indirect, incidental, special, punitive or consequential damages;
• loss of profit, revenue, business, goodwill or opportunity;
• loss, corruption or unavailability of data;
• harm resulting from reliance on AI-generated output;
• harm resulting from failure to seek veterinary advice;
• third-party services, platforms, integrations or app stores;
• events outside our reasonable control.

To the maximum extent permitted by law, our total liability for any claim related to the Service will be limited to the amount you paid to Dr. Fluffy for the Service during the 12 months before the event giving rise to the claim, or EUR 100, whichever is higher.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, intentional misconduct, gross negligence or mandatory consumer rights.

19. Indemnity

If you use the Service on behalf of a business, organisation or professional activity, you agree to indemnify and hold Dr. Fluffy harmless from claims, losses, liabilities, damages, costs and expenses arising from your breach of these Terms, misuse of the Service or violation of third-party rights.

This clause does not apply to consumers where it would be prohibited by applicable law.

20. Changes to the Service and Terms

We may update these Terms from time to time.

If changes are material, we will take reasonable steps to notify you, such as by email, in-app notice or website notice.

If you continue to use the Service after the updated Terms become effective, you accept the updated Terms. If you do not agree, you must stop using the Service and may cancel your subscription according to the applicable cancellation process.

21. Termination by you

You may stop using the Service at any time.

You may delete your account where this feature is available or contact us to request account deletion.

Deleting the app from your device may not automatically cancel your subscription. If your subscription is managed by Apple, Google or another platform, you must cancel it through that platform.

Some data may be retained where required or permitted by law, including for legal, tax, accounting, security, fraud prevention or dispute resolution purposes.

22. Governing law and disputes

These Terms are governed by the laws of [insert country], unless the mandatory consumer protection laws of your country require otherwise.

If you are a consumer residing in the European Union, you may also benefit from the mandatory consumer protection rules of your country of residence.

The courts of [insert jurisdiction] will have jurisdiction, unless applicable consumer law gives you the right to bring claims in another jurisdiction.

Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue informally.

23. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, the remaining parts will remain in effect.

The invalid part will be interpreted or replaced in a way that best reflects the original purpose, to the extent permitted by law.

24. Entire agreement

These Terms, together with the Privacy Policy and any additional terms presented for specific features, form the agreement between you and Dr. Fluffy regarding the Service.
